DanaIX Terms and Conditions

1. Overview

This document specifies the level, conditions, and quality features of DanaIX cloud services and is referred to as the "Service Level Agreement" or SLA. In this document, the company offering its services under the brand name DanaIX is referred to as the "Company," and the recipient of these services is referred to as the "User" or "Beneficiary." DanaIX commits in this agreement to provide its services within a specified range of availability (Uptime), performance stability, and technical support. In the event of disruptions determined to be caused by DanaIX infrastructure and not subject to the limitations specified in this document, the User may be eligible for compensatory credits (Service Credits). This SLA applies only to users who utilize Growth, Professional, or Enterprise support packages, have made their payments in full and on time, and have no outstanding balance. Users on free, trial, or promotional plans are not covered by this document.

Use of any DanaIX services constitutes full acceptance of this SLA. If you do not agree to the terms of this document, please refrain from using DanaIX services. The Company reserves the right to review, amend, or update this document at any time. Notice of changes may be provided through the user panel, email, or publication on the DanaIX website. Users are required to periodically review the latest version of this document on this page.

2. Definitions

For clarity, the terms used in this document are defined as follows:

  • 30-Day Period: A 30-day period starting from the activation of a paid service by the user.
  • Available Time: The period during which the service was available and operational without disruption (as defined in the SLA).
  • Monthly Fee: The amount paid by the user for a specific 30-day period of a service.
  • Monthly Uptime Percentage: The percentage of the 30-day period during which the service was available without disruption. This ratio is calculated as: Uptime % = (Maximum Available Minutes - Downtime) / Maximum Available Minutes Ă— 100
  • Downtime: Any outage or disruption directly caused by DanaIX infrastructure that is not excluded under the "Limitations" section. The precise definition of disruption for each product is set out separately in this document.
  • Service Credits: Compensatory credit applied to the user's account if DanaIX breaches the SLA and causes a disruption.
  • Growth / Professional / Enterprise Service Credit Rates: The percentage of credit granted in the event of a disruption, based on the support package purchased by the user (Growth, Professional, Enterprise).

    3. Limitations

    In the following circumstances, potential service disruptions will not be eligible for Service Credit:

    Including unforeseeable events beyond DanaIX's control, such as:

  • Natural disasters, war, civil unrest, or international sanctions
  • Legal action or orders from government authorities
  • Widespread failures in national or international internet infrastructure
  • Network issues outside DanaIX's control, domestically or abroad
  • Disruption in connectivity between data centers and the national internet
  • 3.2. User Error or User-Side Issues

  • Incorrect settings in the user panel or improper service configuration by the user
  • Network, software, or hardware issues on the user's side
  • Insufficient bandwidth or issues with the user's primary website hosting
  • 3.3. Unauthorized or Abusive Use of Service

    Including:

  • Running malware, unauthorized cryptocurrency mining, sending spam, or DoS/DDoS attacks
  • Unethical or illegal use of DanaIX infrastructure
  • Violation of security policies and acceptable use terms
  • 3.4. Matters Arising from Court Orders or Legal Requirements

    Such as:

  • Court orders or government mandates to suspend service
  • Compliance with technical policies or regulations related to cloud services
  • 3.1. Circumstances Beyond the Company's Control

    3.2. User Error or User-Side Issues

    3.3. Unauthorized or Abusive Use of Service

    Acceptance of Terms of Use

    By registering with DanaIX and using any of our services, you confirm that you have read this document, accept it, and agree to comply with it.

    Definitions

    User: Any individual or legal entity that registers with DanaIX and uses our services and products. In this document, they are referred to as "User," "Customer," or "You." Company: The company offering services under the brand names DanaIX and DanaIX Cloud. This term may include the parent company and its subsidiaries or affiliates. Services and Products: All cloud services, solutions, and products made available to users by DanaIX. User Data: Any information that the user uploads, stores, or processes on the DanaIX platform.

    Intellectual Property Rights

    All intellectual property rights in the DanaIX brand names and variations, as well as all content, software code, designs, illustrations, training materials, user interfaces, and other elements produced on the DanaIX website (and related subdomains), belong to DanaIX. Any use, republication, imitation, or exploitation, whether direct or indirect, for personal, commercial, or public purposes is permitted only with prior written authorization from DanaIX. In the event of any unauthorized use, DanaIX reserves the right to pursue legal action to enforce its rights.

    Compliance with the Laws of the Islamic Republic of Iran

    DanaIX is a company registered in Iran and operates within the laws and regulations of the Islamic Republic of Iran. Accordingly, any use of DanaIX services to publish, host, or transmit illegal content is prohibited. This includes (but is not limited to) indecent or sexual content, promotion or sale of drugs, military or weapons of mass destruction equipment, support for terrorist groups, secessionism, or other activities that violate the law. If such a violation is identified, DanaIX will immediately suspend service and no refunds will be made.

    Compliance with International Law and User Responsibility

    By using DanaIX services, you agree to comply with applicable international internet standards and the laws of the jurisdiction where you use the services, in addition to the laws of the Islamic Republic of Iran. If your use of the services creates legal liability for DanaIX, all consequences rest with you. DanaIX may, at its discretion or upon request by competent authorities, provide information about the user, IP, infrastructure, or other related data, or suspend the user's services. In such cases, amounts paid will not be refunded.

    Confidentiality

    DanaIX is committed to protecting your information. By registering and using our services, you allow DanaIX to analyze and filter traffic passing through your systems for security purposes within the framework of the privacy policy, and to make related statistical and security reports available in the user panel. All information related to a website or service, including contact details, security certificates, user behavior, and similar data, is treated as confidential by DanaIX and will not be disclosed to any person or entity, domestic or international, except where required by law. Important: If a legal order (judicial or administrative) is issued by competent authorities in Iran or other countries where DanaIX has infrastructure, some confidentiality obligations may be suspended or terminated. In such cases, DanaIX has no liability for disclosure and no objection will be accepted. Non-confidential information: DanaIX reserves the right to process information and traffic passing through its cloud infrastructure for analytical and service improvement purposes. This information may be used for product development, infrastructure optimization, deployment of new points of presence, and technical decision-making, in accordance with the DanaIX privacy policy. DanaIX may also route and use traffic through operator networks or domestic and international internet exchange points (IXPs) in accordance with its technical policies.

    User Account

    To create an account with DanaIX, you must provide accurate information that matches your official identification documents. You are solely responsible for the accuracy and currency of this information. If any of your details change, you must update your account as soon as possible. DanaIX has no liability for problems arising from incorrect or incomplete information, or from failure to protect your password properly.

    Password Protection

    Although DanaIX has implemented measures to discourage weak passwords, choosing and keeping a secure password is entirely your responsibility. If your account is compromised due to a weak password, disclosure of your password, or negligence in protecting it, DanaIX has no liability. We strongly recommend using strong passwords, enabling two-factor authentication (2FA), and avoiding storing or sharing your password in any form.

    Digital Communications

    By registering and using DanaIX, you agree that all our communications with you (including notices, emails, SMS, ticket responses, etc.) will be conducted digitally. These methods of communication are legally valid and replace traditional methods such as phone calls, fax, or in-person visits.

    Newsletter Subscription

    By creating an account, you allow DanaIX to send you informational and newsletter emails and SMS. If you do not wish to receive them, you can unsubscribe via the link provided. Note that by unsubscribing, you may miss important account or service notices, and DanaIX has no liability in that regard.

    Use of Free Services

    DanaIX free services do not include dedicated support, SLA (Service Level Agreement), or compensation for disruptions. DanaIX reserves the right to change or discontinue free services at any time. Your use of these services constitutes acceptance of these conditions and does not create any obligation on DanaIX to continue them. A Fair Usage Policy applies to all our free services.

    Beta Versions

    If a service is released on DanaIX as a Beta version, it means the service is not in a final, stable state. Use of such services for sensitive applications or delivery of final products to customers is not recommended. DanaIX may change or remove Beta services and associated data at any time. These services are not covered by SLA or compensation for disruption, and data recovery is not guaranteed.

    Gift Codes, Discounts and Promotions

    Gift codes, discounts, and other amounts credited to user accounts as part of campaigns, promotions, or incentive top-ups are issued for use only on that account and may not be transferred, sold, or assigned to another user. These amounts are not redeemable for cash or refundable, and if you cancel service, they will not be included in any refund. Gift and discount amounts appear only as wallet or invoice credit and may be used only for DanaIX cloud services. Each gift code has an expiry date; if not used within the valid period, the credit is automatically voided and cannot be renewed or reissued.

    Acceptable Use Policy (AUP)

    To ensure security, stability, and quality of service, DanaIX has established an Acceptable Use Policy that defines the framework for permitted use of our infrastructure. Under this policy, activities such as: sending spam; infringing intellectual property rights; abusing infrastructure resources; or attempting unauthorized access or malicious activity are prohibited and will be addressed. By registering with DanaIX, you agree to comply fully with this policy. Violations may result in temporary or permanent account suspension and legal action.

    Privacy Policy

    DanaIX is committed to protecting user information and data in accordance with its privacy policy. That policy covers how information is collected, stored, used, processed, and shared with third parties (where applicable). By using DanaIX services, you confirm that you have read and agree to that policy.

    Fair Usage Policy (FUP)

    Resources for each DanaIX service package are designed based on typical user consumption. If your usage exceeds the fair use limits set, your service may be restricted. The Fair Usage Policy is applied monthly per account and applies to all free and paid packages. Exceeding this limit is determined by technical criteria, usage behavior, and DanaIX review. If your use of resources affects the performance or quality of service for other users, temporary or permanent restrictions may be applied.

    Termination of Service

    To stop receiving services from DanaIX, you must first stop all active services and delete your data. Otherwise, services are considered active and you remain responsible for payment and settlement. Terminating use means forfeiting any data associated with the service. If your account balance goes negative or DanaIX detects malicious or illegal activity on your part, DanaIX may suspend services entirely without your consent and will notify you by email. If your use of the products is inconsistent with their intended purpose, or if you have abnormal usage outside fair use, DanaIX may restrict or suspend your access without prior notice.

    Account Deletion

    To request account deletion or deactivation, you may submit a ticket or email to [email protected]. After review, you will be informed of the outcome and feasibility of deletion. Note: For legal reasons, including anti-money laundering and financial crime regulations, financial transaction data and account records may be retained by DanaIX even after account deletion.

    Refund Conditions

    Refunds are only possible when all of the following conditions are met:

  • Legal action or orders from government authorities
  • Widespread failures in national or international internet infrastructure
  • Network issues outside DanaIX's control, domestically or abroad
  • Disruption in connectivity between data centers and the national internet
  • Additional conditions:

  • Incorrect settings in the user panel or improper service configuration by the user
  • Network, software, or hardware issues on the user's side
  • Insufficient bandwidth or issues with the user's primary website hosting
  • Responsibility for End Users

    If you use DanaIX services to provide services to your own end users, you are directly responsible for complying with all regulations and rights relating to those users. Any complaint, infringement of third-party rights, or abuse of services is legally attributable to you as the primary user.

    Data Backup

    Backing up data and information stored on DanaIX infrastructure is entirely the user's responsibility. DanaIX assumes by default that users regularly back up their important data. Therefore, if data is lost or deleted for any reason, DanaIX has no responsibility to recover it.

    Compensation

    If, due to user action, negligence, or breach of these terms, damage is caused to DanaIX, other users, or technical infrastructure, DanaIX reserves the right to pursue legal action and claim compensation from the user.

    Value Added Tax

    All prices shown on user invoices include value added tax in accordance with current laws. If the legal tax rate changes, the amounts on invoices will be updated accordingly.

    Force Majeure

    In circumstances such as natural disasters, war, sanctions, strikes, widespread internet outage, or other events beyond DanaIX's control, DanaIX has no liability for delay or cessation of service. We will make every effort to minimize the impact on our users, but until such circumstances are fully resolved, there is no commitment to continue service.

    Dispute Resolution

    In the event of a dispute between the user and DanaIX, the first step will be to resolve the matter through negotiation and mutual agreement. If agreement cannot be reached, the dispute will be resolved through arbitration or the competent legal authorities.

    Right to Change Terms and Services

    DanaIX reserves the right to change technical specifications, plans, pricing, or terms of use at any time without prior notice. The latest terms of use will always be available on the DanaIX website. Continued use of the services after changes take effect constitutes acceptance of the updated version.
